7. REVIEW OF COPYRIGHT COMPLAINTS

Upon receiving a credible copyright complaint, Naijamp3express may review the complaint and the relevant content.

Depending on the circumstances, we may:

  • Contact the person who submitted the content;
  • Request additional information;
  • Temporarily restrict access to the content;
  • Remove the content;
  • Disable promotional activity involving the content;
  • Restore content where a complaint is determined to be unfounded or resolved;

Where appropriate, affected parties may be directed to resolve disputes through the appropriate legal or rights-management process.

8. COUNTER-CLAIMS AND DISPUTED CONTENT

If content has been removed or restricted following a copyright complaint, the submitting user may contact Naijamp3express with information demonstrating that:

  • They own the relevant rights;
  • They have authorization to use the content;
  • The complaint is incorrect; or
  • They otherwise have a lawful basis for the content.

Naijamp3express may consider the information provided and determine whether the content should remain removed, be restored, or remain restricted.

9. REPEAT INFRINGEMENT

Naijamp3express may restrict, suspend or terminate accounts or users who repeatedly submit content that is credibly alleged or determined to infringe the rights of others.

Repeated infringement may also result in the rejection of future submissions or promotional requests.

10. UNAUTHORIZED MUSIC

Naijamp3express does not authorize users to submit music that they do not have permission to publish or promote.

Examples may include:

  • Another artist’s unreleased music submitted without authorization;
  • Unauthorized recordings;
  • Copyrighted music falsely presented as original;
  • Stolen promotional materials;
  • Music uploaded by someone without the required rights; or

Naijamp3express may remove or reject such material when identified.

11. REMIXES, SAMPLES, COVERS AND COLLABORATIONS

Users submitting remixes, samples, covers, interpolations, collaborations or derivative works are responsible for obtaining any permissions or licenses required for lawful use.

Naijamp3express does not guarantee that a remix, sample, cover, collaboration or derivative work is legally cleared merely because it has been submitted to or published by the platform.

13. TRADEMARKS AND BRANDING

Users must not use third-party trademarks, logos or branding in a way that falsely suggests sponsorship, endorsement, partnership or authorization.

Naijamp3express may reject or remove promotional materials that create a misleading impression about a relationship with another individual, company, artist or organization.

14. USER-SUBMITTED ARTICLES AND WRITTEN CONTENT

Users may submit biographies, press releases, articles, interviews and other written materials.

The submitting user is responsible for ensuring that the material:

  • Is accurate to the best of their knowledge;
  • Does not unlawfully copy another person’s work;
  • Does not contain fraudulent claims;
  • Does not unlawfully disclose private information; and
  • Does not violate applicable law or Naijamp3express policies.

Naijamp3express may edit submitted material for formatting, spelling, clarity, length, accuracy or editorial standards.

  • Musician;
  • Producer;
  • Record label;
  • Business;
  • Organization;

Naijamp3express reserves the right to review content submitted to the platform.

We may remove, edit, restrict, reject or decline to publish content where reasonably necessary to:

  • Protect users;
  • Protect copyright holders;
  • Comply with law;
  • Protect the website;
  • Maintain editorial standards;
  • Prevent fraud or abuse;

  • Respond to legitimate complaints.

Removal of content does not necessarily mean that Naijamp3express has determined that the person who submitted it committed an offence.

18. PROMOTIONAL CONTENT

Paid promotional services do not override Naijamp3express content standards.

Payment for a promotion package does not guarantee that Naijamp3express will publish or promote content that violates this Policy, the Terms of Use, applicable law or the rights of others.

Where possible, Naijamp3express may offer the Customer an opportunity to correct or replace problematic material.

19. COPYRIGHT AND PROMOTION REFUNDS

If promotional content is removed because of a credible copyright complaint, rights dispute, unlawful content or false ownership claim, any refund will be handled according to the Promotion Packages, Refund & Cancellation Policy and the circumstances of the case.

Where promotional work has already been performed, a full refund may not necessarily be available.

Nothing in this section is intended to remove rights that cannot legally be excluded.

The person submitting content is responsible for claims arising from their submission where the claim results from their lack of rights, authorization, inaccurate information or other wrongful conduct.

This does not prevent Naijamp3express from taking reasonable action to investigate, respond to or resolve complaints.
