PROMOTION PACKAGES, REFUND & CANCELLATION POLICY
Effective Date: 12 September 2026
This Promotion Packages, Refund & Cancellation Policy (“Policy”) explains the rules that apply when an artist, record label, business, organization, promoter, DJ, or other customer (“Customer”, “you”, or “your”) purchases or requests a paid promotional service from Naijamp3express (“Naijamp3express”, “we”, “us”, or “our”).
This Policy forms part of the Naijamp3express Terms of Use. By purchasing, paying for, or authorizing a promotion package, you agree to this Policy and the applicable package description.
1. ABOUT PROMOTION PACKAGES
Naijamp3express provides music, entertainment and promotional services designed to help artists, businesses and other eligible customers increase the visibility and exposure of their content, releases, brands or services.
Promotion packages may include services such as:
- Music promotion
- Website publication or placement
- Artist or song features
- Playlist promotion
- Social media promotion
- Advertising placements
- Promotional banners
- Articles or editorial features
- Music campaign packages
- Artist profile promotion
- Other promotional services offered by Naijamp3express
The exact service included in a package is determined by the package description, banner, quotation, invoice, written agreement, or other offer provided by Naijamp3express.
2. PACKAGE DETAILS
Customers should carefully review the package details before making payment.
A package may specify:
- The promotional service provided
- Number of songs, posts, banners or materials included
- Promotional placement
- Campaign duration
- Platforms or channels included
- Required promotional materials
- Delivery conditions
- Any package-specific restrictions
Where a package contains specific conditions, those conditions apply to that package.
Naijamp3express may update, replace, discontinue or introduce promotional packages at any time. A package already purchased will generally remain subject to the terms applicable when the purchase was accepted, unless otherwise agreed.
3. PAYMENT
Payment must be received through a payment method or arrangement authorized by Naijamp3express.
A promotion package is not considered confirmed until Naijamp3express has received the required payment or otherwise confirmed the order.
Payment of a package constitutes confirmation that the Customer has reviewed and accepted:
- The package details;
- This Policy; and
- The applicable Naijamp3express Terms of Use.
4. MATERIALS REQUIRED FROM THE CUSTOMER
Depending on the package, the Customer may be required to provide materials such as:
- Music/audio files
- Artist name
- Song title
- Cover artwork
- Artist photographs
- Promotional graphics
- Biography or description
- Social media handles
- Website links
- Streaming/download links
- Contact information
- Logos or business information
- Other materials reasonably required to provide the service
The Customer is responsible for ensuring that all submitted materials are accurate, complete and usable.
Naijamp3express may delay the start or completion of a campaign where required materials have not been supplied.
5. CUSTOMER’S RIGHTS TO SUBMITTED MATERIALS
By submitting music, photographs, artwork, videos, logos, text, links or other materials for promotion, the Customer confirms that they have the necessary rights, permissions or authorization to provide those materials for the requested promotional purpose.
The Customer remains responsible for copyright, trademark, publicity rights and other rights relating to materials supplied to Naijamp3express.
Naijamp3express does not assume ownership of the Customer’s content merely because the content is submitted for promotion.
6. WHEN PROMOTION BEGINS
Unless a package states otherwise, promotional delivery begins after:
- Payment has been confirmed; and
- Naijamp3express has received the required and usable promotional materials.
The timing of delivery may therefore depend on when the Customer supplies complete materials.
If the Customer submits incomplete, incorrect or unusable information, the campaign may be postponed until the issue is resolved.
7. CAMPAIGN DURATION
Where a package has a stated promotional duration, the campaign will normally operate within that stated period.
Campaign duration does not necessarily mean that every individual promotional activity will remain continuously visible for the entire period.
For example, a campaign may involve scheduled posts, rotating placements, limited-time advertising, website publication, social media activity or other promotional methods.
Naijamp3express determines the reasonable scheduling and implementation of promotional activities unless a specific placement or schedule has been expressly agreed.
8. NO GUARANTEE OF RESULTS
Payment for a promotional package does not guarantee a particular number of:
- Streams
- Downloads
- Views
- Likes
- Comments
- Followers
- Subscribers
- Sales
- Bookings
- Viral reach
- Chart positions
- Playlist placements
- Media coverage
- Awards
- Fan engagement
- Revenue
Promotion is intended to provide exposure and promotional opportunities, but audience response is outside the complete control of Naijamp3express.
Unless a specific result is expressly stated as a guaranteed deliverable in writing, the Customer should not treat projected or expected performance as a guaranteed outcome.
9. CUSTOMER REQUESTS AND CHANGES
After a package has been confirmed, the Customer should provide accurate information before promotional work begins.
Requests to change:
- Song
- Artist name
- Artwork
- Promotional text
- Links
- Images
- Campaign information
- Social media details
- Other submitted materials
may be accepted at the discretion of Naijamp3express.
If substantial work has already been completed, Naijamp3express may be unable to accommodate the requested change or may require an additional arrangement.
10. CUSTOMER-CAUSED DELAYS
Naijamp3express is not responsible for delays caused by the Customer, including:
- Late submission of materials
- Missing information
- Incorrect links
- Copyright disputes involving Customer content
- Failure to respond to necessary requests
- Failure to provide usable promotional materials
- Requests to postpone or change the campaign
- Other circumstances within the Customer’s control
Where reasonably possible, Naijamp3express may reschedule or extend delivery to account for such delays.
11. CANCELLATION BEFORE PROMOTION STARTS
A Customer may request cancellation before promotional work has started.
Whether a refund is available will depend on the circumstances, including:
- Whether work has already begun;
- Whether promotional space or resources have already been committed;
- Whether third-party costs have been incurred;
- The nature of the package; and
- Any specific cancellation terms communicated for the package.
Where no work or non-recoverable commitment has occurred, Naijamp3express may provide a full or appropriate refund.
12. CANCELLATION AFTER PROMOTION HAS STARTED
Once promotional work has started, cancellation does not automatically create a right to a full refund.
Where part of the service has already been delivered, Naijamp3express may consider:
- The portion of the service already completed;
- Work already performed;
- Promotional placements already used;
- Non-refundable costs or commitments;
- The remaining undelivered portion of the package.
Where appropriate, Naijamp3express may offer a partial refund, rescheduling, replacement service or another reasonable resolution.
Nothing in this Policy is intended to remove any rights that cannot legally be excluded under applicable law.
13. REFUNDS WHERE NAIJAMP3EXPRESS CANNOT DELIVER
If Naijamp3express accepts payment but is unable to provide a substantial part of the paid promotional service for reasons attributable to Naijamp3express, Naijamp3express may, depending on the circumstances:
- Reschedule the campaign;
- Provide an alternative promotional service of reasonably comparable value;
- Extend the campaign;
- Provide a partial refund; or
- Provide a full refund where appropriate.
The appropriate remedy may depend on how much of the service has already been delivered and the circumstances preventing completion.
14. CONTENT REJECTION OR REMOVAL
Naijamp3express may refuse, suspend or remove promotional content where it reasonably believes that the content:
- Infringes copyright or other intellectual property rights;
- Contains unlawful material;
- Contains fraudulent or deceptive information;
- Violates Naijamp3express rules;
- Creates a legal or platform-related risk;
- Contains prohibited material;
- Is subject to a legitimate rights complaint; or
- Otherwise cannot reasonably be promoted through Naijamp3express.
Where payment has already been made, any refund or alternative remedy will depend on the circumstances and the amount of service already performed.
15. COPYRIGHT AND RIGHTS DISPUTES
The Customer is responsible for ensuring that music and other promotional materials submitted to Naijamp3express can lawfully be promoted.
If a legitimate copyright or rights complaint arises, Naijamp3express may temporarily suspend or remove the affected promotional material while the matter is reviewed.
Naijamp3express may request evidence of authorization or ownership where reasonably necessary.
A Customer’s payment does not transfer responsibility for copyright or ownership disputes to Naijamp3express.
16. FALSE OR MISLEADING INFORMATION
Customers must not submit false information about:
- Artist identity
- Song ownership
- Music credits
- Awards
- Streaming numbers
- Chart positions
- Endorsements
- Business claims
- Promotional achievements
- Copyright ownership
- Other material facts
If misleading or fraudulent information is discovered, Naijamp3express may cancel, suspend or remove the promotion.
Refund eligibility will depend on the circumstances, including whether the service has already been provided.
17. NO FAKE ENGAGEMENT
Naijamp3express does not authorize customers to use promotional services for fraudulent manipulation of audiences, platforms or performance statistics.
Customers must not request or use Naijamp3express services for activities involving fake streams, fake downloads, bot engagement, artificial followers, fraudulent reviews or other deceptive engagement practices.
Naijamp3express may reject such requests or terminate related promotional activity.
18. PACKAGE TRANSFER
A promotional package purchased for one artist, song, business or campaign generally cannot be transferred to another artist, song, business or campaign without prior approval from Naijamp3express.
Naijamp3express may approve a transfer where reasonable, particularly where promotional work has not yet begun.
19. EXPIRATION OR UNUSED SERVICES
Where a package has a specified validity period, the Customer should use the package within that period.
Unused promotional services may expire where:
- The Customer fails to provide required materials;
- The Customer repeatedly postpones the campaign;
- The package has a stated expiration date; or
- A reasonable period has passed after Naijamp3express requested the required information.
Where appropriate, Naijamp3express may allow rescheduling instead of expiration.
20. THIRD-PARTY PLATFORMS
Some promotional activities may involve third-party platforms, websites or social media services.
Naijamp3express cannot guarantee the continued availability, algorithms, policies, visibility, reach or functionality of third-party platforms.
If a third-party platform removes, limits, changes or restricts promotional content, Naijamp3express will consider the circumstances and may provide an alternative where reasonably possible.
21. CUSTOM OR SPECIAL PROMOTION PACKAGES
Custom promotional packages may have conditions different from standard packages.
Where Naijamp3express provides a customized quotation or written agreement, the specific terms of that arrangement will apply to the extent they differ from the standard package conditions.
22. PROMOTIONAL MATERIALS CREATED BY NAIJAMP3EXPRESS
Where a package includes the creation of promotional artwork, banners, graphics, captions, articles or similar materials, the Customer is responsible for providing accurate information and approved materials where requested.
Naijamp3express may make reasonable editorial or design adjustments to ensure that promotional materials meet its quality, branding or platform requirements.
23. SERVICE COMPLETION
A promotional package is considered substantially completed when Naijamp3express has delivered the promotional services or deliverables described in the applicable package.
A package does not remain open indefinitely merely because the Customer does not achieve the desired promotional results.
Performance results such as views, streams, downloads or engagement are not themselves evidence that a paid service was not delivered.
24. HOW TO REQUEST A REFUND OR CANCELLATION
Refund or cancellation requests should be submitted to Naijamp3express through the available official contact channel.
The request should include:
- Customer name;
- Artist or business name;
- Package purchased;
- Date of payment;
- Payment reference or other transaction information, where available;
- Reason for the request; and
- Any other information reasonably required to identify the order.
Naijamp3express may review the request before determining the appropriate resolution.
25. REFUND PROCESSING
Where a refund is approved, it will normally be processed through the applicable payment method or another reasonable method agreed with the Customer.
Processing time may depend on the payment provider or financial institution involved.
A refund decision does not necessarily mean that every fee or transaction cost associated with a payment will be recoverable.
26. STATUTORY RIGHTS
Nothing in this Policy is intended to exclude, restrict or remove any consumer or other legal right that cannot lawfully be excluded or restricted under applicable Nigerian law.
Where applicable law provides a Customer with rights greater than those stated in this Policy, the applicable law will prevail.
27. CHANGES TO THIS POLICY
Naijamp3express may update this Policy from time to time to reflect changes to its services, business practices, technology or applicable requirements.
The version applicable to a particular purchase will generally be the version in effect when the package was accepted, unless otherwise required by law or agreed with the Customer.
28. RELATIONSHIP WITH THE TERMS OF USE
This Policy should be read together with the Naijamp3express Terms of Use.
If there is a conflict between this Policy and a specific written agreement for a customized promotional package, the specific agreement may control the relevant service, subject to applicable law.
